1. Application of these Terms and Conditions

This 3MBS Box Office website ("Website") is owned by Music Broadcasting Society of Victoria Limited (trading as "3MBS Box Office"). By using the Website, or by otherwise purchasing tickets through 3MBS Box Office, you agree to be bound by these terms and conditions. 3MBS Box Office may change these terms and conditions at any time without notice, and you agree to be bound by such changes. Any such changes will be posted on the Website.

2. Website Intellectual Property

You may only visit and use the Website for reviewing information about events offered by 3MBS Box Office and purchasing tickets to such events. Except for one permanent copy as a personal record of purchase, content on the Website may not be used, reproduced, copied, stored, altered, posted, uploaded or transmitted in any form or by any means, except as permitted by the Copyright Act 1968 (Cth).

3MBS Box Office or their suppliers own all intellectual property in the content and software of the Website. You may not redistribute, sell, decompile, reverse-engineer or disassemble such software or otherwise reduce it to a human-perceivable form.

Your use of the Website does not create a license with respect to the intellectual property (including trade marks) in or on the Website.

3. Ticket Sales and Conditions

3MBS Box Office is the ticketing agent selling events on behalf of the presenter of an event ("Presenter"). Tickets are sold subject to these Terms and Conditions and the 3MBS Box Office's Refund and Exchange Policy set out on this Website. All persons attending an event must hold a valid ticket for that event. Late arrivals may not be allowed entry until a suitable time in the performance. The Presenter reserves the right to refuse entry to persons on reasonable grounds (such as intoxication). The Presenter reserves the right to request persons to leave the performance on reasonable grounds (such as causing disruption to others or making an unauthorised recording of the event).

The Presenter reserves the right to vary advertised artists, support performances, programmes and seating arrangements.

Ticket holders must comply with all reasonable security arrangements for the event, such as bag searches. The Presenter reserves the right to confiscate items it reasonably considers should not be permitted in the venue, such as bottles, cans, weapons, fireworks, alcohol and illicit drugs. Electronic equipment (such as cameras, video recorders, mobile phones and pagers) may not be allowed in certain venues, and ticket holders must comply with all reasonable requests regarding such equipment.

Tickets may not be re-sold or transferred for commercial gain without the prior approval of 3MBS Box Office. Tickets sold or transferred in breach of this condition are voidable and the holder may be refused entry to the event.

4. Third Party Websites and Content

The Website may contain content provided by other parties, including Presenters ("Third Party Content"), or links to websites operated by other parties ("Third Party Websites"). While care has been taking in compiling the Website, 3MBS Box Office is not responsible for any Third Party Content or Third Party Websites. 3MBS Box Office does not necessarily endorse, and make no representations concerning Third Party Content or Third Party Websites, or any products or services offered by third parties. You access any Third Party Website at your own risk.

5. Disclaimer

The Website and its content are provided on an "as-is" basis. 3MBS Box Office does not represent or warrant that the Website will be error-free or uninterrupted, or that material downloaded from the Website will be free of viruses or other destructive features.

6. Limitation of Liability

Except as set out below, 3MBS Box Office excludes all:
(a) warranties relating to this Website, its content and your use of the Website;

Where any law implies any term into your use of the Website, and that term may not be excluded at law, then that term applies. However, to the extent permitted by law, 3MBS Box Office limits their liability for the breach of any such term to the resupply of services.
